RENTAL LIABILITY WAIVER & RELEASE
Introduction & Agreement
This Waiver is executed by the primary guest on behalf of themselves, their traveling party, visitors, and minors ("Guest") for the short-term rental at 220 Loch Way, Eatonton, GA (house, basement game room, grounds, dock, waterfront). Booking, checking in, or signing evidences agreement to all terms.
1. CANCELLATION & CHARGEBACKS: Policy is Firm. No exceptions. Refunds follow firm policy minus 3% processing fee. Guest agrees terms are fair and waives the right to dispute legitimate charges (chargebacks) with their credit card company for any issues covered here or by platform terms.
2. COMPLIANCE: Guest must follow all rules on booking platforms (Airbnb, Vrbo, Hostfully), the property binder, and this agreement. Violations, lawbreaking, or damage will result in full liability for costs, fines, legal issues, and immediate eviction without refund.
3. ASSUMPTION OF RISK: Guest acknowledges using the waterfront property, grounds, and amenities involves inherent risks of injury, illness, or damage, and voluntarily assumes all risks during the stay.
4. LAKE WATER SAFETY & EQUIPMENT:
Swim at Own Risk: Direct lake access and private dock; no lifeguard. Guest assumes sole responsibility for safe usage. Diving is strictly prohibited. Proper swimwear required.
Kayak: Use of the single provided kayak is at Guest's own risk. No life jackets are provided. Guests must provide their own properly fitting Personal Flotation Devices (PFDs); life jackets are highly recommended on the water.
Off-Limits: Owners' personal boats, jet skis, boat lifts, and locked closets are strictly off-limits. Guests may tie legally rented watercraft to the dock using provided cleats.
5. AMENITIES: Follow all safety guidelines:
Fire Pit: Check local burn bans before lighting. Never leave unattended. Extinguish fully with water after use. Guest assumes full financial/legal responsibility for property damage, wildfire, or injuries.
Gas Grill: Operated safely by adults only.
Game Room: Use of pool table, foosball, and gear is at Guest's own risk. Supervise children closely.
6. SECURITY MONITORING: Exterior cameras monitor access points and the driveway. No cameras inside or in private outdoor areas. Tampering or obscuring cameras results in immediate eviction and deposit forfeiture.
7. ENVIRONMENT & WILDLIFE: Lakeside environment. Despite regular treatment, encounters with wildlife, bugs, spiders, or insects may occur. Host is not liable for natural elements of the Georgia lakeside.
8. LIABILITY LIMITS & INDEMNIFICATION: Guest releases Host and Property Owner from all liability for injury, water-related accidents, illness, death, or property/valuable loss. Guest agrees to indemnify Host against all claims brought by any member of their party or visitors.
